Whinchat Artists Licence
What you promise and what you give when you add a song to the music library.
The operator has not yet published: legal entity name, registered address, governing law / jurisdiction, legal contact address, privacy contact address. Each missing item is marked in the text below. Until they are published this service should not be taking money from the public.
This is the licence you give when you add a song to the Whinchat music library from Settings → Share your music. You keep your copyright. What changes is that people on Whinchat may put your song on their updates, credited to you.
Who can add music
You must be 18 or over, because this is a licence, and a licence is a contract. Every song is listened to by our team before anyone else can hear it. We may decline a song without giving a detailed reason, and we will tell you in your chat with the app.
What you promise
- You own the recording, or you control it and may license it.
- You wrote the song, or everyone who wrote it has agreed to this licence. That includes lyrics, melody, and any sample or beat you did not make yourself.
- Nobody else has a claim that this licence would cut across. This means no record label, publisher or distributor you have signed with, and no collecting society (such as ASCAP, BMI, SESAC, PRS, SACEM, or a society in your own country) that the song, or you, is registered with for performance or reproduction rights. If you are a member of a collecting society, you probably cannot give this licence for free, even for your own songs. Ask the society before you upload.
- The song breaks no law and none of our other policies.
If a promise turns out to be untrue, we will remove the song, and you are responsible for claims that follow from it.
What you give Whinchat
A non-exclusive, worldwide, royalty-free licence to store, copy, stream and play the song on Whinchat, and to let people on Whinchat add it to their updates and play it there. It is non-exclusive: you may still sell, stream or license your song anywhere else. We do not pay for the licence and you do not pay us. The licence is only for use inside Whinchat. It does not let anyone download your song for use somewhere else, and we do not offer a way to.
How you are credited
The artist name you give is shown with the song in the music sheet and on every update that uses it, with a link to this page.
Taking it back
You can withdraw a song at any time from Settings → Share your music. It leaves the library at once, and we delete the file, so updates that already use it fall silent. Updates last 24 hours, so none of them play it for long. We may also remove a song at any time, for example after a copyright notice (see Copyright & DMCA), and we will tell you why.
What we keep
The song, its title, the artist name, genre and language you gave, and the date and version of this licence you agreed to, until you withdraw the song, delete your account, or we remove it. The agreement itself is in your data export.
